Act while you can

An enduring Power of Attorney has to be made while you can still understand it. The witness must certify that they explained the document to you and that you appeared to understand its effect.

  4. Step 4: Registration assistance

    If your POA will be used for property transactions, we assist with registering it with NSW Land Registry Services.

Questions

Common questions about powers of attorney

What is the difference between a general and an enduring power of attorney?

A general Power of Attorney stops working if you lose the capacity to make your own decisions. It can be useful for a particular purpose, for example while you are travelling or living overseas. An enduring Power of Attorney keeps working if you lose capacity, for example through illness, injury or disability.

Can my attorney make health and lifestyle decisions?

No. In NSW, an attorney can make financial and legal decisions only. To choose someone to decide where you live and what health care and medical treatment you receive, you appoint an enduring guardian in a separate document. We can prepare both at the same time.

What happens if there is no power of attorney?

If someone loses capacity without one, a relative or another person may need to apply to the NSW Civil and Administrative Tribunal (NCAT) for a financial management order so that their finances can be managed.

Does a power of attorney need to be registered?

If your attorney may need to deal with real estate for you, the power of attorney must be registered with NSW Land Registry Services before a property dealing signed under it can take effect. We explain whether yours needs to be registered, and we can help with registration.

Can I change or cancel it later?

Yes. You can update or cancel your Power of Attorney at any time, as long as you still have the capacity to make that decision. We can help you change or revoke it.
