CM Law’s Ultimate 50 Things You Need to Know About Property Settlement During Divorce #41: How does one obtain interim financial orders?

How do you obtain interim financial orders after separation?

To obtain interim financial orders, identify the relief needed, provide financial evidence and apply to the Federal Circuit and Family Court of Australia using the appropriate procedure. The court can consider maintenance, access to property or protective orders before final settlement. Financial pressure alone does not establish entitlement to every requested order.

For NSW couples, these applications generally arise under the Family Law Act 1975. You do not need to wait for divorce. A lawyer should identify the correct legal basis, eligibility requirements and evidence before an application is filed. De facto claims also require the applicable relationship and jurisdictional thresholds to be met.

Which type of financial assistance or protection do you need?

Interim financial relief covers different legal mechanisms, each with its own purpose and requirements. Maintenance addresses support, an interim property distribution provides access to assets, and an injunction protects property against demonstrated risks. Child support generally follows a separate assessment process. The order sought should match the actual problem requiring attention.

Pathway What it may address Important limit
Interim maintenance Reasonable living expenses, potentially including housing payments. Requires the relevant maintenance test; not automatic income equalisation.
Interim property distribution Access to assets for a justified purpose, potentially including housing or legal expenses. Must be just and equitable and preserve a fair final outcome.
Property injunction A demonstrated risk of assets being sold, transferred or depleted. A protective restraint, not an award of ownership.
Child support Financial contributions towards children’s needs. Usually assessed through Services Australia under separate rules.

Services Australia assesses child support in most eligible cases. The court has specific child-support and child-maintenance powers, but these are not a general substitute for that system.

When can the court order interim spousal or de facto maintenance?

Ordinary interim maintenance requires evidence that the applicant cannot support themselves adequately for a recognised reason and that the other party is reasonably able to pay. The court considers reasonable needs and available resources. A difference in incomes, unemployment or the length of the relationship does not automatically establish an entitlement.

Relevant matters include care of children, health, age, earning capacity, assets and financial resources. Explain why employment or other resources cannot meet the shortfall. The maintenance criteria require assessment of both parties. The June 2025 reforms expressly recognise relevant economic effects of family violence, such as impaired employment capacity or additional treatment expenses.

What evidence should support your application?

Your evidence should explain the amount or restriction requested, why it is needed and the financial position supporting it. Use a realistic budget and current records, distinguishing essential expenses from estimates or discretionary spending. If funds exist but cannot be accessed, explain the practical restriction and provide documents showing the problem.

  • Income records, tax returns, bank statements and relevant business or trust documents.
  • Mortgage or rent statements, utility bills and evidence of imminent arrears or deadlines.
  • A budget showing income, expenses, existing support and the remaining shortfall.
  • Medical or employment evidence explaining earning limitations, where relevant.
  • Records of threatened transfers or withdrawals if asset protection is sought.

Comply with the continuing duty of full and frank disclosure. Update changed circumstances and disclose relevant resources even where they weaken your application. Avoid counting expenses already met by the other party twice.

Which application and supporting forms must you file?

For a new financial proceeding, an Initiating Application ordinarily seeks final orders and any interim orders required. In existing relevant financial proceedings, interim relief is generally sought through an Application in a Proceeding with an affidavit. A divorce application alone is separate, and a parenting-only case may require amended documents introducing financial claims.

Under the financial proceedings practice direction, an ordinary new application also requires a current Financial Statement, Genuine Steps Certificate, Undertaking as to Disclosure and any applicable family-violence order. An affidavit supports interim relief; a Financial Questionnaire is not additionally required where the Rules require that affidavit. Check the filing guidance and any special procedural directions.

Must you negotiate before applying?

Parties generally must take genuine steps to resolve a financial dispute before starting proceedings, unless an exception applies. Negotiation, disclosure and a specific proposal may produce an interim agreement without a contested hearing. Urgency, family violence or undue prejudice can justify an exception; the reasons must be properly explained and supported.

A Genuine Steps Certificate ordinarily accompanies an Initiating Application. It is not required with an Application in a Proceeding; address settlement attempts or the relevant exception in the supporting affidavit. Where agreement is possible, ask your lawyer whether consent orders are appropriate. Do not delay necessary protection to pursue unsafe direct negotiations.

What if you need money or asset protection urgently?

An urgent listing requires evidence explaining why the application cannot wait for an ordinary hearing. Identify the immediate consequence, such as essential expenses falling due or a threatened asset transfer. Request urgency in the application, support it by affidavit and provide a cover letter referring to the relevant affidavit paragraphs.

The Court’s urgent procedure allows some other documents to follow later. An early hearing is not guaranteed. Separately, urgent maintenance under sections 77 or 90SG may address immediate need where it is impracticable to determine the substantive maintenance order immediately. Legal Aid NSW explains how this differs from ordinary interim maintenance.

Does the other party receive notice, and what happens at the hearing?

Ordinarily, the other party must receive the filed documents and an opportunity to respond. The court considers the affidavit evidence, financial information and submissions before deciding what interim relief is justified. An interim hearing does not ordinarily resolve every disputed fact or determine the final division of all property between the parties.

Urgency alone does not remove service requirements. Applications without notice require additional justification and full disclosure under rule 5.11. The practice direction requires those applications to be filed by registry email, rather than through the Commonwealth Courts Portal. Obtain advice about service, evidence limits and the precise proposed orders.

What does Hall v Hall show about financial resources?

Hall v Hall [2016] HCA 23 demonstrates that interim maintenance depends on resources practically available to the applicant, not only legally enforceable entitlements. The High Court dismissed the wife’s appeal by majority, leaving in place the discharge of interim maintenance after finding that financial support from her family’s business was available.

Her late father’s will expressed a wish that the family business provide her with $150,000 annually. The evidence supported an inference that her brothers, who controlled the business, would arrange payment if she requested it. The High Court’s reasons treated that available support as a financial resource.

The decision does not mean that having wealthy relatives defeats a claim. More than hoped-for generosity is required. Although decided before the 2025 reforms, it remains a useful illustration of why evidence about accessible resources matters.

Will interim orders determine the final settlement or stop a lender?

Interim maintenance and protective orders do not themselves determine the final property division. An interim property distribution can have lasting financial consequences and must be considered when deciding the final outcome. Orders allocating mortgage payments between former partners also do not automatically alter the lender’s contractual rights against either borrower.

Keep records of payments and comply with the order’s duration and conditions. Seek advice about variation if circumstances change; do not simply stop paying. A partial property distribution must be justified under the property powers, with attention to preserving a fair final outcome. It is not an automatic right to withdraw half the joint funds.

What deadlines and costs should you check before applying?

Check limitation periods, filing requirements and likely costs before applying, while acting promptly if essential needs or assets are at risk. Maintenance proceedings generally must begin within twelve months after divorce takes effect or two years after a de facto relationship ends. Starting outside those periods requires advice about permission and available exceptions.

The Court’s maintenance guidance explains these limits. Obtain a proportionate estimate for legal work and any filing fee; hardship exemptions may be available. There is no standard hearing timetable or guaranteed payment. For help with interim relief and your wider property settlement, contact Christine Manolakos at CM Lawyers.
